CLOAKROOM OPERATING RULES
These Cloakroom Operating Rules (hereinafter referred to as the “Cloakroom Operating Rules”) govern the rules and conditions of use of the cloakroom in the interior of the TOP HOTEL Praha, Blažimská 1781/4, Prague 4 (hereinafter referred to as the “cloakroom”). The cloakroom is the only place designated for storing things in connection with attending an event and, for security reasons, also the only place where such items are usually stored. All customers using the cloakroom are obliged to familiarize themselves with these Cloakroom Operating Rules and comply with them.
By handing over the item to the cloakroom and receiving the confirmation of receipt of the item, the customer accepts these Cloakroom Operating Rules and concludes with the cloakroom operator, the company:

A contract on the custody of movable property within the meaning of Art. 2402 and Section 1751 par. 1 of Act No. 89/2012 Coll., the Civil Code, as amended.
1. Operator
The cloakroom is operated by Downstream s.r.o., Gutova 2134/26, 100 00 Prague 10 – Strašnice, which ensures the operation of the cloakroom on its own behalf and under its own responsibility as part of the “LIVE EXOTICS” and “LIVE BOTANY” events held in the premises of TOP HOTEL Praha, Blažimská 1781/4, Prague 4.
2. Operating hours and storage period
The cloakroom is open only during the relevant event in the building of the TOP HOTEL Praha, Blažimská 1781/4, Prague 4 (hereinafter referred to as the “Event”), usually from the opening of the entrance to the public before the start of the event until a maximum of 30 minutes after its completion. Other hours of operation of the cloakroom will be communicated by posting at the cloakroom on the respective day of the event.
The time of the event and the opening of the cloakroom for this event is the maximum agreed storage period.
3. Payment for the storage of things
For the storage of things in the cloakroom, the customer is obliged to pay the price in advance according to the current cloakroom price list, which is available at the cloakroom. For each individual item deposited, the customer pays this price separately, unless the operator stipulates otherwise. The customer will receive a receipt in the form of a ticket with a unique identification number (hereinafter referred to as the “ticket”) about the payment and receipt of the item for safekeeping.
The customer is entitled to request the issuance of a confirmation of the payment made, no later than at the time of payment of the escrow price.
4. Safekeeping and Item Identification Number
After taking over the item to the cloakroom, it will be marked with an identification number identical to the number stated on the ticket. The case will be issued only against the presentation of this ticket to the cloakroom operator. Each item must be recorded with a separate ticket. You can’t store more than one item on a single ticket.
Items for which the customer has not been issued a separate ticket are not included in the escrow and are not subject to the operator’s liability.
At the same time, the operator is not responsible for the loss or damage of items that are stored inside another discarded item without their own ticket, especially if the customer was not demonstrably notified of their presence when handing them over to the cloakroom.
5. Taking back the item by the customer
The customer is obliged to pick up the stored items without undue delay after the end of the event, but no later than 30 minutes, always before the cloakroom closes.
Unclaimed items will be written down in protocol and deposited at the address designated for the following purposes: Downstream s.r.o., Masarykovo náměstí 18, 254 01 Jílové u Prahy, for a period of 7 days, this period starting from the day following the day of the event. Items left in the cloakroom can be picked up at this address by prior arrangement with the operator on tel.: 606 379 809 or e-mail: .
To issue them, it is necessary to:
• presentation of the ticket,
• Presentation of a valid identity card,
• Entering your name, address, date of birth,
• payment of any fees (listed in the cloakroom price list),
• signing of the acceptance protocol.
If the customer does not collect the items within the period specified above, these items are considered abandoned. In such a case, the operator is entitled to dispose of them at its own discretion. The Operator is not responsible for any damage incurred in connection with the handling of such uncollected items.
6. Losing a ticket
In the event of loss of the ticket, the deferred item may be issued to the customer after proving his identity with a valid card, communicating and recording the name, address and date of birth, and after paying any unpaid fees according to the cloakroom price list.
The item will be handed over to the customer last, i.e. at the moment when all other items left from the cloakroom are handed over, after a detailed description of the item deposited by the customer.
The Operator is not liable for damage caused if the deferred item is handed over to another person on the basis of a lost ticket.
7. Items discarded and items excluded from storage
The customer is entitled to put in the cloakroom only the items usual for visiting the event, especially outerwear (e.g. coats, jackets) and similar personal belongings.
Valuables or items of higher value, especially cash, jewellery, documents, keys, electronics or other similar items, cannot be placed in the cloakroom. The operator is entitled to refuse to accept such items.
Furthermore, the operator does not assume responsibility for items stored inside the items stored (e.g. in clothing pockets or luggage).
In the event that the customer hands over an item for safekeeping contrary to these Cloakroom Operating Rules, the operator is not responsible for any loss, damage or other damage to such items.
8. Prohibited Items
It is forbidden to store dangerous items in the cloakroom, in particular:
• explosive, narcotic, psychotropic, highly flammable, toxic or otherwise dangerous substances, pressure vessels and other materials that may cause a threat to human health, the environment or property due to their chemical or physical properties,
• firearms and ammunition,
• heavily soiled or smelly items,
• unusual things.
Live animals cannot be placed in the cloakroom, unless the operator expressly decides otherwise.
8a. Animals (exceptional acceptance)
In exceptional cases, the operator may allow the storage of a small animal if it is placed in a closed, safe and sufficiently ventilated transport box appropriate to its species and size, which is also properly secured against the escape of the animal.
The customer is responsible for ensuring that the animal is eligible for temporary placement in such a box and that its placement does not endanger its health or surroundings.
The operator is not responsible for the health condition of the animal or for any damage caused to it, unless there has been a breach of the operator’s obligations.
The operator is entitled to refuse to take over the animal at any time or to demand its immediate collection if its storage would be inappropriate or risky.
The animal must be placed in a transport box for the entire period of storage.
Other provisions of these Cloakroom Operating Rules shall apply to animals accordingly, unless otherwise stipulated in this Article.
9. Luggage
The customer is obliged to hand over the luggage to a cloakroom properly closed and secured so that its contents do not fall out of it.
The Operator is responsible for the Baggage as a whole and is not responsible for its contents or for any loss or damage to items stored inside the Baggage.
The Operator is entitled to require the presentation of the contents of the luggage in order to verify that it does not contain items the storage of which is contrary to these Cloakroom Operating Rules. In the event of refusal, the operator is entitled to refuse to accept the baggage.
Live animals must not be placed in luggage without the knowledge and consent of the operator.
However, the provisions of Article 7 (items of exceptional value), Article 8 (prohibited items), Article 8a (animals) and Article 11 (items of extraordinary value) of these Cloakroom Operating Rules shall apply to items from luggage.
10. Refusal to take the item to the cloakroom
The Operator reserves the right to refuse to accept the item into the cloakroom, in particular if the maximum capacity of the cloakroom is reached or does not meet the conditions set out in Articles 7, 8, 8a or 11 of these Cloakroom Operating Rules.
11. Items of extraordinary value
Valuables, especially cash, jewellery, documents, keys, electronics or other items of higher value cannot be placed in the cloakroom. The operator is entitled to refuse to accept such items.
12. Exclusion of liability for items handed over in violation of the Cloakroom Operating Rules
In the event that the customer breaches its legal or contractual obligations, in particular if it fails to notify the operator of the facts or the nature of the items in accordance with these Cloakroom Operating Rules, the customer is liable for the damage incurred and is obliged to compensate the operator.
13. Complaints
Complaints must be filed without undue delay, usually on the day of the event. Complaints made later may not be taken into account.
